K1: Marriage and filling out of the AOS within the 90 days
 
Hi you all!!!

I have got a question: I read somewhere that the INS doesn't like it very much when you get married on day 85 between 90 when you are in there on the K1. They would prefer it much more if you get married right away and fill out the AOS right away. Is that true? Or can the AOS also be filled out after the 90 days? I am insane because I don't know when we will get the certified copies of the wedding licence back from court.

From what i understand as long as you were married before the 90 days were up you can file for AOS without any problems even if you dont actually file til after the 90 days.

The only requirements are:

a) You can married within the 90 days. This is a pretty firm requirement and if you
don't comply you'll have to file an I-130 with the I-485.
b) You file to adjust status within the 90 days. This is much more wishy-washy.
Most INS offices will allow you to go a "little" bit over (where "little" is
totally undefined) and still accept the I-485 based on the K-1. But they could
insist on an I-130.

If you meet both of those requirements, they couldn't give a monkeys whether you got
married and filed on day 1 or day 90.

As long as you marry within the 90 days, you can file the AOS after the 90 days. The
law only specifies a marriage within the 90 days. However, bear in mind, after the
90-day period, you are out of status. Alvena

Hi,

We had problems (due to a misunderstanding) getting a certified copy of our marriage
certificate. We got married on about day 50 but due to the problems with the marriage
certificate and the fact that we had to wait two weeks for an appointment to file in
person it was almost day 150 before I filed the AOS and nothing was even mentioned
about my filing so late.
