K-3 and Criminal Record?
I've been looking at the new(ish) K-3 visa as an option when we send in our I-130 application next year. The problem is that I *know* the I-130 will be denied on criminal grounds, and we will then have to apply for a waiver of ineligibility.
So, the big question is "Would the K-3 even be an option for us?"
Has anyone in a similar situation already been through this process?
Would a waiver of ineligibility for the K-3, also count for the I-130? (The K-3 would also be denied, and denial is the only way to apply for a waiver).
Basically, would the K-3 save us any time, or just cause even more headaches and heartaches? The extra cost we could deal with if it meant we were together sooner.
I'm mostly concerned with the likelihood that if I did get a K-3, the denial of the I-130 would terminate it, thus forcing me to leave the USA within 30 days. Even though we'd be applying for a waiver, that wouldn't be processed in that short a time.
