J-1 and J-2 Visa "legal spouse"

Default J-1 and J-2 Visa "legal spouse"

Hi, i'll be going to the US for a couple of years to take up a research position at a university. I've been told that i'll be on a J-1 visa. Looking through the information i can see that my legal spouse would be able to join me either immaediately or at a later date on a J-2.

The thing is that i am not yet married to my girlfriend. Would it be possible for us to apply for a J-2 after i have been in the US for some time, we are planning on getting married 5 months after i am due to take up my position? or is it neccessary that, to get a J-2 visa, we must be married BEFORE i get my visa and that my original application and hers must go in at the same time?

Yes, it is possible that the J-2 dependent apply for a visa (or change of
status) after the J-1 holder has been in the U.S. for some time.

No, you need not marry before you obtain your J-1 visa. You may marry
later, and your spouse may obtain a J-2 visa, or J-2 status, after that.

You can marry her after you have your J1, and she can apply for J2 whenever she likes. She does not have to come to the US at the same time.

She can even come along as your girlfriend. In order to do that, she
would either have to use the visa waiver and stay for three months, or
she could apply for a tourist visa together with your J-2, stating as the
purpose of the visit "will get married and apply for change of status to
J-2 on XXXX" For fiances of non-immigrants, this is specifically
permitted.
