Default INCOME TAX RETURNS

Hi everyone,

My interview will be coming up shortly and INS have requested tax
return for 1999 which we do not have. My wife did not file for that
year, she was in school with the support of her ex-husband. She did a
few odd jobs but claims she cannot remember exactly where.

Do you think we will have a problem? we have all the other returns,
plus she has a decent job. At the moment, I am a nervous wreck not
knowing what to do..who to call...or where to start. Your advise
would be greatly appreciated, Thanks.

I was told before that you need a written statement saying why you did not
file taxes for a certain year. What I did for my up-coming AOS paper work is
called the IRS and asked them to send me my tax transcripts for the last 3
years and for 1999 she printed out on the same paper that I did not work for
that year. I don't know if that is good enough but according to answers
before I believe that it will be enough proof. They does not cost anything
for the tax transcript and it comes from IRS themselves so I think it should
be good enough. Hope this helps!

She can backfile for the missing year now and submit that with her I-864 or do as Sheila suggested and the instructions state and include a letter stating why she was not required to file for that year.
INS is interested in your current situation and your ability to maintain it. Remember that the objective is to insure that you (alien) do not become a public charge.
