Illegal Alien trying to get married to stay in the U.S.

Default Illegal Alien trying to get married to stay in the U.S.

I know someone who has overstayed her visa. She is trying to get married to stay in the country. Someone told her that even if she gets married that she has to go back to her country for 6 months to complete paperwork. I thought if she got married that she could file for green card with the INS. Can someone explain to me how this works?

That depends. If she originally entered legally, the overstay would be forgiven and
she can file for AOS. No need to go back to the home country. In fact, leaving the US
would trigger a 3-year or 10-year ban, during which she would not be able to enter
the US at all. If she entered without inspection, e.g., by sneaking over the border,
she would not be able to get a GC.

In her case, she's just as legitimate as all other legitimate applicants when doing
the AOS. She only overstayed her visa. Even INS forgives people in her situation.
Just go check INS publication about who can do AOS if you don't trust me.

Thankfully, 245(i) is no longer effective. With enough letters to our local
representatives and the power of the citizen ballot, we can keep it that way.

How can she be legitimate if the post states that she is trying to get married to stay in the country? If she were going to get married anyway, that would be different but it does not say that.

What if they really don't have anyother way around? For instance what if a kid
that was send here when he or she is 10 and have lived here 12+ years and still
don't have GC and his i-94 has been expired because of neglection on the adults
part? If the kid leaves now he can never get back into the US which he spend a
great part of his childhood here, and what if when he gets back to his own
country he is forced to serve in a country that he practically don't remember, a
country that he is supposed to call "home"? Since his i-94 has expired for over
10 years there is really no way for this kid to stay here. Or is there?

those are very rare compared to scam marriage like this, I would say 50% of illegal

You know someone commeting fraud and you are not doing anything about it. Then you
are a partner in the crime. I think you should inform the INS about it.

weather she is doing this for just stay in US or weather for nationality in any case you should keep in mind that the INS officials who are taking AOS interviews they are experienced and been doing this for years and many many case of illegal applicants came in front of them. i am not saying you should go for it or not its your business. but i want you to know that be carefull it may happen that she do it for nationality or stay in US and after going in front of INS official every thing comes clear and she is messed up.
