if my fiance is philippino and i'm us military stationed in s. korea?

Default if my fiance is philippino and i'm us military stationed in s. korea?

which embassy do i consult for a fiance visa to south korea...i am stationed here until june 2003...she is in the philippines , and i want her to come here so i can marry her...would it be the us or philipine embassy ??in seoul or in manila?

Sorry, I misunderstood originally, or you didn't say she was from the
Phillipines.
She or you should consult the South Korean Consulate or Embassy in the
Phillipines to see if she can get a visa to South Korea. If you are
later going to live in Japan, you should also consult their Embassy or
Consulate in the Phillipines. This is not a US immigration issue. If you
were to ask how to get her to the US, that would be related to this
newsgroup. However, you want her to move to SK and the Phillipines.

You might try contacting the government agencies in Korea or the
Phillipines that handle immigration, or you might consult with an
attorney in those areas knowledgeable about immigration. Additionally,
you might try locating Korean and Japanese related newsgroups and asking
there. You might also search www.google.com for sites relating to Korean
and Japanese immigration.

Hi:

She contacts the Korean embassy in Manila. They can also tell her about the requirements for getting married in Korea.

For the requirements applicable to YOU, go to www.asktheconsul.com and drill down through American Citizen Services. They suggest you contact the Phillipine consulate in Seoul to find out the Korean requirements for a Filipina visiting the ROK.

After you are married, you can file your I-130 with the INS office located in the US Embassy on Sejong Ro in Seoul. Note that this is NOT a "direct consular filing" -- you are filing with INS and you can do it on a walk-in basis.

I don't know the procedures to allow your new spouse to remain in Korea with you. This might be part of the SOFA -- but I don't know. Your local JAG might be of assistance on this.

If she is able to remain in the ROK, she will then process for the immigrant visa in Seoul at the US Embassy. If she has to return to the PI to wait, she will apply at the US embassy in Manila.

BTW, on the much feared I-864, you need only prove that you make 100%, not 125% of poverty level.

This is a little confusing since it seems that you want to move your
fiance to Korea, and not the United States.
If you were talking about getting her into the US I think you could
file your petition (I-129F) at the INS Service center of your last
place of residence in the United States. That's what my fiance did,
but he was stationed with the Navy on a carrier for only 6 months.
But if you are talking about getting her to Korea she will need a
Korean, and not a US visa (if she needs a visa at all). If you are
gonna get married outside US you will have to file for a spousal visa
after marriage to be able to take her home (US) with you.

You could also contact the INS field office in Seoul, Korea, which is
a sub office of the Bangkok district. They don't issue visas, but they
might process your petition. They do process I-130 (spousal visa).

Hi:

Your information is correct and amplifies what I wrote. I understood the gentleman as asking how his beloved could get into Korea for the purpose of getting married. And then he wanted to see about the green card.

I refrained from talking about her LIVING in Korea. I don't know much about Korean immigration law other than through knowledge about how some expatriated friends have done it. However, I think that once they are married, she would become a military dependent and her status would be based upon the US-ROK SOFA and not immigration laws per se.
