Default I 94 question

Hi..I am on L1 visa and my visa got expired in May'03. My I94 is valid till Dec'03. But the problem is that I want to go to my Home country urgently before my I 94 expiry. The question is can my company apply for my L1 extension now , but I will not be here during that time . Then my company can send my extension papers to my Home country and with those extension papers i get my visa stamped and come back again to US.I heard this is possible or does it involve any legalities that I have to be here if my L1 extension is filed.Let me know of this..

I think you get 30 days grace at the end of the visa before you have to be out of the country. Also, you apply for a change of status, you can stay in the country while it is being processed.

Hope this helps, but you really need to talk to an immigration lawyer, as they know all the loopholes, and if you get it wrong, you'll never be allowed back in.
