I-751... moving along !

Default I-751... moving along !

okay... I think the things are moving along with my I-751 petition to the CSC. Here is my timeline so far:

Mailed via certified mail with return receipt - Sept 24th, 2002
Confirmed delivery via online tracking - Sept 27th, 2002
Return receipt received - Oct 3rd, 2002
Check cleared from the bank - Oct 3rd, 2002
Letter from INS with receipt number and 1 year extension received - Oct 4th, 2002

I have one question about the letter I received from the INS with the receipt number and one year extension for employment and travel (Form G-854). Is this what people in the group refer to as NOA ? Becuase I could not find any mention of NOA anywhere in the letter, also this is such an ugly looking paper... much like the PIN number you receive for your credit card which you have to tear open from the sides and reveal the contents ?

Oh dear . . . . Don't want to rain on anyone's parade, but, yes, the
cashing of the check, the NOA (that's the form you
received--notification of action), these things all tend to happen
very quickly indeed; most people in this community have had the same
lightening response from the INS . . . .Quite heartening, really--and
pleasantly surprising after we have all been through the earlier
stages--until the stark reality (and literalness) of the "you will not
hear from us for at least . . . " kicks in . . . . What timeline did
CSC give you?

Well, your dates are about identical to ours, except ours are from 2001. We
first filed October 1, 2001 and received the NOA in a timely fashion. In
about May of 2002, we received notice for my wife to appear at the Los
Angeles INS office. She spent five hours there waiting, and then it was to
finishing processing the I-751 and stamp her passport, extending her visa
date. They said she will receive her 10 year green card in about 6 months
or so. As of this date, we still have not received it.

NOA = Notice of Action. That is what your form is.

Hi:

The I-751 applications, for some reason, are not processed through the "TIERS" database of the INS. TIERS generates form I-797 "Notice of Action" notices. In contrast, the older system that I-751's are on generate the G-854 notices. [BTW, asylum applicants get similar notices for I-589's].

The processing times vary enormously. Do remember that while the I-751 is pending, the alien spouse remains a "lawful permanent resident." After one year, if the case is still pending, he can go in to the local district office and get an I-551 temporary stamp in the passport.

Also, here in LA, if the case is still pending at the time of the third anniversery of admission [minus 3 months] and the alien spouse has been living the US spouse the entire time, an N-400 naturalization application can be filed -- even if the I-751 is still pending. The two applications will be combined and adjudicated together by the Los Angeles District Office.
