Does anyone know if my spouse can adjust status in the USA even if she is supposed to pick up the visa in the UK, (per the I-130 application form).

Or can we make another I-130 application?

Also the original visa has already been approved, but not received by NVC

Appreciate any help/advice.

If your I-130 petition has been approved and you have the approval notice, what I
would do is contact the London consulate and ask them to open a provisional file. She
can get ready for the interview once she gets the packet 3. (In fact, if she goes to
London consulate website, she can download the forms right now and get ready)

In the meanwhile, NVC will forward the petition on to London, as they will not wait
for you to send them I-864 for UK, as I understand it, so your wait at NVC won't be
too long. Send her your I-864 and supporting evidence, as this process is getting
close to the finish for you. I do not recommend her entry as tourist at this
time...instead just get ready for intervie win London.

Hi there!

Godon and I just did this. We had an I-130 filed with TSC, but not yet approved. He
returned with me from my visit to the UK when I was sick and he wound up staying with
me. We filed AOS in Memphis even though our I-130 said 'consular processing in
London'. All we needed was a copy of where we had filed the original and the INS
officer in Memphis said to be sure and keep the approval notice that we receive from
TSC when it was finally approved. We will need this when we go for our AOS interview
later on since the orignal notice was sent to London.

Michelle,

When Gordon returned with you what visa did he enter the US with? Were there any
problems at immigration POE?

My wife and I just received our 2nd NOA and I am hoping to visit her soon to
celebrate our anniversary. I was wondering what the problems may be.
