i want to know if a person got married with a girl in Maryland but he is resident of WV and also have a drivers license of WV can he apply his AOS from WV ?

The filing place would be the INS office that has jurisdiction over the place where the USC and the foreign spouse will be making their home together. It does not matter where you marry, in West Virginia, New York, Detroit or Los Angeles. Nor does it matter where the foreign spouse has lived before or has a driver's license from. The qualifier is where the couple makes their home.

It must be filed in the state they are going to live in. If he's moving to
MD, it would be filed with the Vermont Service Center (special exception for
Marylander's - they get to file at the Service Center). If she is moving to
WV they file there.

thax a lot, yes they are planing to come to WV so now they will apply at Pittsburgh PA
