can anyone plse help/advise me????? i have been in the us for just over 60 days on the 90 day visa waiver programme. i have met that special lady and we are going to get married asap----b4 the 90 days are up.
my question is this----once married do i have to return to the uk or can i stay in the us and do all the paperwork from here. this marrige was not planned but has just happened as things do sometimes. any info on the legal aspect of our dilema would be greatly appreciated

If what you say is true, then if you are eligible (no crimes, no visa
fraud in your past, etc), then you should be fine, IF you are marrying a
US citizen. For instance, if when you entered the country, you lied
about being employed in your home country, that might be a problem (If
they wrote that down or otherwise recorded it)

Hi:

From what you write, you should not have a problem unless the INS decides to create one. In solving immigration problems, it is usually better to be within the United States than outside trying to get in.

An alien IN the United States has some rights, not many, but some. An alien outside has no rights.

thanx for this-----we were both worried that once we were married i could still be asked to leave and wait for the paperwork to go through

DO NOT LEAVE !!!! If you leave then it will be a long time before you will
be able to get back in. You should apply to change your status and also
apply for advanced parole if you need to leave the country for any reason.
If you leave before you get advanced parole you will have a lot of mess
getting back in.

If you file the paperwork and they ask you to leave, then you have done
something wrong and you are going to have a problem coming back.
RELAX... As long as no fraud was committed on entry and you are not
disqualifed in any other way (criminal, lack of sponsor funds, etc),
then you will be OK on entering under visa waiver.
