Help ..

Hi,
I'm from the US. My fiance, who is from Wales and lives there and we are planning on getting married in the UK.
What is the proper proceedure for her to get to Chicago once married ?
Can she come to the US on tourist visa after we are married and then change her status.

Any help will be appreciated.

Thank you.
Ruben

Hi Ruben,

Firstly take a look at the following ;-

I'm no expert but I think you will be looking for a K3 Visa and I think it will mean
you being apart for a few months after the wedding.

Do you have to get married in Wales? By all accounts it is simpler if your fiance
travels to the USA on a Visa Waiver and as long as the entry to the USA is 'clean'
get married and adjust status. Read the Tourist Adjustment section of the Doc Steen
site above.

If you don't get an answer from anybody else try reposting it as a direct question to
Alvena or Andy Platt, they both know much more than I do.

Re: Help ..

If you get married in Wales, then you would have to return home alone and file an
I-130 petition for her to get a spousal visa to come to the US. This can take about a
year to process. However once you receive your first NOA from the I-130, you can then
file for a K-3 visa so she can come to the US sooner - about 6 months. She cannot
enter the US on a tourist visa after you are married and file to adjust status
because that would be visa fraud - you can't immigrate to the US on a tourist visa.
Not to mention that if she told the agents at Customs/INS at the airport she was
coming to the US to be with her husband, she would be sent back anyway. You might
consider a K-1 fiancé visa - then have her come to the US to get married, and later
you can return to Wales for ceremony with her family. Start reading here at Doc
Steen's site - http://www.mindspring.com/~docsteen/...o/visainfo.htm this will
give you all the options available to you and a great look into the wonderful world
of immigration. If you chose to marry first in Wales - the I-130 Help Site gives a
step by step direction of the process

(fiancé visas) and the K-3 visa see www.k1faq.com Take Care. Shelley
