H4 Visa - Reg
 
Hello Experts,

Presently I am in US on H1 B visa. I have transfered my H1 to another company and got the approval and is currently valid. But the stamp of my previous company in my passport is expaired. Now I am planning to go to India and get married and come back on H4 visa.

Will there be any problem in issuing me H4 visa because I am already in US on H1.

I appriciate any replies.

There are a few issues, none of them major.

First, the H-4 visa falls into the same six-year limit as H-1Bs. That is, if you
already spent four years on H-1B, you would get only two on H-4.

Second, you must work for your employer until the day you depart, and when you
return, you must not work for that employer any more because you would be an H-4. It
might be a bit tricky convincing the consulate of that, although by no means
impossible.
