on H1-b visa and filling I-130 through my brother.
Hi everybody,
I wish that someone could answer my question.
I am in the US on h1-b visa, my brother is a US citizen. After he files form I-130 for me, if I get laid off can i stay legally in the united states because I have a pending petition with the INS?
or it won't make any different ...and I won't be able to stay in status..

No, you can't. You can't stay here legally until there is a visa number available for
you, which in your case (US citizen petitions for his sibling,) will take some where
between 15 to 20 years or longer.

you, which in your case (US citizen petitions for his sibling,) will take some where
