on H1-b visa and filling I-130 through my brother.
Hi everybody,
I wish that someone could answer my question. I am in the US on h1-b visa, my brother is a US citizen. After he files form I-130 for me, if I get laid off can i stay legally in the united states because I have a pending petition with the INS? or it won't make any different ...and I won't be able to stay in status.. Thanks in advance. |

No, you can't. You can't stay here legally until there is a visa number available for
you, which in your case (US citizen petitions for his sibling,) will take some where between 15 to 20 years or longer.
