H-1B to I-765
 

I really need help with this. My H-1B visa is valid until July 29, 2002. I left and came back into US in late June and I was given until Aug 8, 2002 on my I-94, which will allow me to work until Aug 8, 2002. I have applied for I-765 in May and received a Receipt Notice with a notice date of Jun 4, 2002.

Q1: Since I am waiting for my I-765 approval, does it mean I can still continue to work after Aug 8, 2002?

If not, I supposed I have to wait until Sep 3, 2002, which is 90 days after the notice date of Jun 4, 2002, before I can work again.

Q2: If that is the case, will it be a problem to my I-485 for being out-of-status between Aug 8 and Sep 3? If yes, how can I avoid it?

Anyone has any suggestion as to what I can do? I will really appreciate your help. Thanks.
