Guardianship of Minor and Will
 
Hey everyone,

Surely this has come up before but I couldn't find anything on the search.

My wife is pregnant with our first child.. She is a US Citizen, I am a UK citizen with a US Green Card. We want to name my brother and his wife, who live in England, as guardians if we die. Does anyone on here have experience of this? Are there any legal issues/special forms needed to name a foreign guardian for a child born in the US?

We did this a long time ago, didn't come up against any problems (legal issues) Our Sons are both USC's but their guardians are both Brits and live in the UK...not sure if anything has changed, this was 21 and 17 yrs ago:)

We did this about 2 years ago for our kids and didn't come up with any legal issues.

Might depend on your state of residence...

Yes, see a family law attorney in relevant state and take things from there. State family courts might not be keen to allow an American child to be shipped off to a foreign country.
