Green card for wife
 

Hello;

I have a few questions about getting my wife a green card as soon as possible. However before I ask these questions I would think it best to give the short version of what happened.

My wife and I met via the internet aproxamately 5 years back...She is Thai and I am American. After 2 years of communicating via internet, phone and private chat..Plaa ( my wife) decided to finish her masters in Florida.... close to where I lived.

After she arrived here..she had two months before she had to start at her college of choice. In that time we sealed what had became somewhat serious over the previous two years.

We had made different plans and she decided to not finish college at the moment. A year later we were married and now we have a little girl added to the family.

Right after we married I was seriously injured at my place of employment...so this forced us to put off getting an immigration lawyer and doing our INS paper work.....Obviously finances were the issue, because we did not know how long this injury or workmens comp case would last.

We thought it would be best to take what monies we had and pay off the remainder of the house and save some for the time I would have to be out of work.

Its good that we did like this because it took two years just to resolve this case...and all we are getting back is 2 years backpay...if that.....So I must return to school now to be retrained at another type of employment , because the doctors refuse to return me to normal lifting or labor..

On my wifes end of the story............................................
She will be losing her visa (expires this month), as well as her drivers licence.

Now ...with the story clear and knowing we will be getting back pay ..........Plaa and I decided we must get her green card
going regardless of our financial situation at the moment.
However we are scared because of how INS has been acting since September 11th.............................................. ......................

My questions are .................................................. .............................

1.)Could they deport my wife now that her Visa has expired...even if we had a child born here together, are married and own a home together?

2.) Who would be the best lawyer in the Tampa Bay area of Florida for the price ( remember our financial situation at the moment)

3.) What would be the best path to follow at this time our given situation

4.) Is there a way that a lawyer could get my wife an extention on retaining her drivers licence while waiting on her visa? Either by some type of tempory paperwork or documents?

5.) lastly ...what are other alternitives that we can look into
in the mean time?

I would love to say that I absolutly adore my wife and she has been angel....concidering the situation we had be thrown into. I would be extremely grateful for any knowledge and advice given here at this forum.

Based upon the facts stated in your message it is extremely unlikely
that the INS would take any action against your wife until a decision
is made upon her application for adjustment of status. You and she
should proceed to file an I-130 and an I-485 right away.
