A GC holder getting married to a F1 Visa student
Hi all ,
I am a LPR here. I want to get married to a girl who is on a on a F1 visa for 3 years , This is her second yaer in states.
Can I sponsor her GC on family based category ?
If I could then are there any restrictions for her of any kind ?

You could file the I-130 for her but until her visa number was current (currently
about five years for the spouse of a permanent resident) she would have to maintain
her own status (e.g. F-1). Furthermore there is a risk that if she needs to extend
that (for instance, to do a master's program) she will be denied because of immigrant
intent. The best thing would be if she could get an H-1B after completing her
education if that's appropriate - otherwise she'll have to leave the US until her
visa number is current.
When you become a US citizen the petition can be converted to an immediate one so
that she could file the I-485 or file for an immigrant visa "immediately" (in
practice there would be a delay while the petition gets converted).
