First time request for a Residency Certificate (taxation)

I am getting ready for my first years taxation in the US (2009, UK pension income is my only income). I was pretty much sorted when I realised I needed a form 6166. I downloaded form 8802 to request one.
As 2009 will be my first filing and I am applying for my first 6166 in the current tax year do I have to input anything into sections 5 and/or 6 (I do have to submit a tax return obviously but non of the check boxes seem to apply when it is for the first and current year year)?
Many thanks for any help

If you are seeking certification for the current tax year and you are going to have to file a 1040 for the current tax year then presumably you should check the appropriate box in section 5.

Check the correct box in section 5- presumably you will have to file a tax return, you just haven't done it yet.
