I am going to marry a US Citizen this May. I was holding H-1B visa but got laid off 4 months ago. Of course after we get married, we wil file for Permanent resdiency immediately. Since I am out of status for 4 months, am I gonna be okay when they are investigating mt status for my application? I didn't expect to get laid off but my fiancee and I were already engaged before I got laid off. Would the INS Officer be nice about situation like that? I am just worried that my case will be denied due to the overstay.
Now I am filing out I-485, where can I find the Non-immigration Visa Number? Also, when they are asking for current occupation, should I be honest and put down "Unemployed"?? But at the same time, I don't want to being up the fact that I am overstaying in US. Since it required me to put down my current status, I put down "H-1B" (tho I already got laid off and the H-1 visa is no longer valid, technically), wouldn't it be contradicting? If so, what should I put down for <Current Status> and <Current Occupation>???
Plus, on the G-325A form (Biographic Data Sheet), where can I find the File Number? What is it? Do I have one?
