F1 to H1B
Hi,
I am currently a F-1 student and I am graduating this december. I have already receive a offer letter and my prospective employer is willing to file an H1b application on my behalf. 1- When can my employer start the process? 2- Can I remain in the US while the H1b application is in process? 3- Do i still have to apply for a work permit? 3- how long does it take (approx.) to complete the H1b paperwork? Thanks, |

The position offered must require a minimum educational level of a bachelor's degree or the equivalent. If you already have a bachelor's degree, the employer could file an H-1B petition now, based on your previous degree. If not, the employer must wait until the degree is granted to file the petition. > 2- Can I remain in the US while the H1b application is in process? Yes, if the H-1B petition plus a request for a change of status is filed with INS prior to the end of your F-1 grace period. > 3- Do i still have to apply for a work permit? It would probably be the best strategy. Why would you even think of not applying for F-1 OPT? > 3- how long does it take (approx.) to complete the H1b paperwork? With premium processing: about one to two month. Without premium processing: 4 to 6 months depending on which INS Service Center serves your area. |
