Hi All,
Trying to find out info for a friend, the wrong country of citizenship was used to obtain a us work permit, apparently uscis ? know this fact
the person is no longer in the USA, anyone any ideas on how they apply for a pardon ?
Any suggestipns welcome as I have no uscis knowledge and wish to help them with any forms/ application

Pardons are handed out by politicians. For a federal crime that necessarily means the POTUS. To get a pardon you your friend will need to engage a heavyweight DC attorney with political connections to do some serious lobbying. Or there has to be some political angle for the President, such as recent pardons that were given to minorities who had been prejudiced by the imbalance in sentences for crack v cocaine possession, and you your friend would still need a lawyer in DC to lobby for you him , perhaps pro bono if you're he's a particularly pathetic case.

BTW pardons are rarely given other than to people who have already served their time for the crime they committed. How much time did you your friend serve? Richard Nixon and Marc Rich are extreme counter examples, but they illustrate how politically connected and/or wealthy you your friend would need to be to get a pardon for a crime that you have he has not already served your his penance for.

What is it that your friend is trying to do? What is the end point, visit the US? Get another work visa? ... ?

How did this friend use the wrong citizenship on the application for a work visa to US. Your citizenship has to be documented by passport or long form birthday at the very least.

Even if the friend used a fraudulent passport, how is the USCIS to know unless the former visaholder came forward and advised them. And, further question, why does this friend NOW need to correct their deliberate "error"? Does the friend now want to enter the US with the correct passport and feels they will be caught at the POE when entering?

Lots of information your friend is leaving out of their store.

What do you mean, wrong country of citizenship? Is your friend a dual citizen? If so, how could this be the 'wrong' citizenship? And how did USCIS find out about this 'error'?

You need to give us the whole story if you want help!

This is all i know.
dual citizenship, canadian and south american country, they applied for work visa using the south american info
my friend wants to be able to sometimes visit a relative in the USA
I will try to find out more next time i see them.

As long as he applied for his work visa using a citizenship he legitimately holds, I don't see what the problem would be. If you are a dual citizen, using whichever is more favourable is a legitimate visa/ immigration strategy, e.g. using an Irish passport to enter the green card lottery, or using a British or European passport to enter the US under the VWP.

It would only become a problem if he was using another passport it to conceal facts that would make him inadmissible to the US, e.g. avoid disclosing a criminal (CIMT) conviction.

I don't see what your friend needs to be pardoned for. From your description, it doesn't sound like he did anything wrong.

The answer is simple.

In order to get a new visa (work or otherwise) a new visa has to be applied for.

The person applying for the visa needs to provide accurate and truthful answers to all of the questions that are asked, both on all of the forms and at the interview (if any).

A visa will either be issued or denied.

If it is denied then, depending on the reason why it was denied their may be ways in which the denial can be overcome.

But he doesn't want another work visa. He just wants to visit the US as a tourist.
