Hi Guys

I worked for Employer A from Nov 2000 till Feb 2002 in US and have the H1 visa stamping for this employer. In feb 2002 he asked me to go back to my own country because of the economic downturn. Within 10 days I found another employer B filing my h1 petition. I returned to my country in Feb. Now i have got the H1 petition approved for employer B and have his offer letter asking me to come there for a project next week. The thing is I haven't stamped the visa for employer B. I presume my visa stamping for employer A is still valid. Can I enter the US with the H1 petition approved for employer B and stamping of employer A. Would that create any problem. One more thing is that my stay in my country is nearly 8 months now. Since the visa stamping for employer B would take some time in my country can i go on the visa which is valid till March 2003.

Thanks in anticipation. I would be extremely grateful if someone can advise me as i am having sleepless nights.

No problem whatsoever. The employer name is only an annotation and has no
legal meaning; the stamp is good for everybody.

Do be sure to bring B's approved petition with you, as well as a letter
from B that states that they are still willing to hire you.

Here is a hint: you have already been out of the US for eight months. If
you can stretch it another four months, your six-year clock would be
reset, and the time you already spent on H-1B would no longer count, so
you'd have more time in the US.
