Driver's Licence Hassles - Please help!
 

I am here on K-1 and just got married. I tried to get a Driver's Licence permit and was told there there needs to be 60 days on the I-94 form. I don't have 60 days on the I-94 form. What should I do? Can I get this extended?

What state are you in? Check with the DMV to make sure this is correct. ASk specifically to see such a rule. From personal experience with our DMV, their clerks aren't always correct about the rules.

Try and go get the 1 year EAD. NY requires the 1 year EAD plus other proof
of birth and identity before issuing the Learner's Permit. Apply for EAD
when you send in your Adjustment of Status package.

Also, the printed forms may be out of date as the laws have changed. The
web site should contain more recent information than the printed
publications.

I live in New Jersey. The clerk and the supervisor told us that we need 60 days in Form I-94. We were unaware and now don't know what to do. First, we went to the DMV in our area. They told us for K-1, you have to get special permission at the Regional Service Center. We went there and they told us that we need 60 days in Form I-94. I am so frustrated by this whole process. Can anybody help? Thanks.

If that's the law, then there really isn't much you can do except do a bit more research to make sure you have not been misinformed. In my state you have to prove 30 days residency before you can apply, so it all varies.
What country are you from? Check to see if your driver's license from home is valid for a period of time in your state. My fiance's German license is valid for up to one year in KY.

Are you saying there has to be 60 days left on the K-1 or that you had
to be here for 60 days?

I'd like to know that also - do you need at least 60 days left on your I-94?

I was also told you driver's abstract could be no older than 30 days.

The OP said there needs to be 60 days on the I-94. I would take that to mean there must be 60 days LEFT on the I-94 in order to qualify for a driver's license.

Have absolutely no clue as to the meaning of driver's abstract? Although a great many drivers do drive in an abstract manner, particulary in New Jersey.

Canada.

Question for fun is do u have to wait for any resedency requirment in NJ... Also can u issue permit while u have 61days and do the actual road test while u have 30days left on I-94

I have just looked on line and it says everywhere that you are allowed to drive for up to one year on a UK license. I have no idea where you come from. However, as I will be moving to Pennsylvania sometime this year and wanted to know what was correct I telephoned PA state driving license office in Harrisburg. I was put through to the examination office and told that I can indeed drive on a UK license for a one year from entry into the US on my fiancee visa. After that I have to attend their office with my passport, social security number, 2 proofs of address in PA and a few other things.

My husband didn't have a license from anywhere, so started from scratch. They wouldn't even issue him a non-driver's id until he came back with the I551 stamp after the interview. Their argument was that the federal government has prohibited them from issuing state id cards to any immigrant whose status is pending. I pointed out that other states issue id cards to immigrants who are waiting to adjust status, but got nowhere. This was at the Sycamore Street headquarters. They did have a pamphlet they printed out to back themselves up.
I would be really interested to see if anyone from PA gets a different story. The issue did not seem to be his privilege to drive. Their primary problem was with him having a state-issued id before BCIS determined that he was a valid immigrant.

Double check on that when you get to PA. Here in Arizona you can drive
for up to one year on a UK driving license too, UNLESS you are a
resident in which case you must obtain an Arizona Drivers License
within 30 days.(or is it 60?)

On the PA DMV website

Not true in all states. In NYS you have to get a NYS driver's license the moment you have established NY residency. Residency for NYS is when you have entered the US for immigration intent. While you can still drive on your country's license, if they want to be hard nosed about it, you can get a ticket for failure to do so if it is shown that you are living and working in the US, especially if you have filed for adjustment of status and have an EAD.

A tourist can legally drive up to one year in the US with their country's driver's license if the license is recognized. But for those people here on this forum, they are not tourists. They are immigrants.
