I deliberately did not comment on the legals success, there are very few open and shut cases and with no disrespect to the OP we only have one side of the issue.

The two issues that would tip the case for me are:

They put the dog down, implies not first bite.

Mention of a previous incident.

Where's the pleasure in owning a dog that you yourself said can be vicious? The animal is a ticking time bomb. If you accidentally upset your dog, you could find yourself mauled.

I've read about the breeding of pet rats. Responsible rat owners do not breed rats with aggressive nature because of the inherent problems with aggressive rats (fighting and injuring each other).

Police dogs for one are extremely well trained, and do not attack indiscriminately, and release when told. As for the OP then i would get at the very least medical expenses, lost wages, etc, maybe more, depending on the relationship to the neighbour, you have to ask yourself the question what would THEY have done had the situation been reversed? (bearing in mind this is the US) I am sorry to hear about the missus i really am, and i hope it doesn't adversely affect her for too much longer. (although this is another thing you have to consider in your decision, if it is PTSD someone will have to pay for the counselling, but as i have said i really hope it doesn't come to that.)

I think you are misinterpreting the OP's motives. Sure, there are frivolous lawsuits - people who spill coffee on their stupid selves and sue McDonalds - but the OP's wife did nothing but pursue her right to cross a street! It was NOT HER FAULT that the dog attacked her. She didn't break into anyone's house, didn't hit anyone, didn't fire a gun at anyone. She was just crossing the street, for goodness' sake!

I love dogs and it pisses me off that some dog owners look at their pets as weapons - especially when their "weapon" has no safety catch! Police dogs are trained to attack on command (it's their job - they are POLICE dogs), and stop attacking on command. The owner of the Great Dane had NO CONTROL over his/her dog and thereby is liable to face the financial consequences of his/her stupid, selfish, and reckless behavior.

If you think the OP is just a money grabber you are missing the point.

p.s. I hope you keep your dog muzzled when you are out in public walking among innocent people.

and if you can find out how much homeowners liability insurance they have sue them for the lot.

it's not a question about money grabbing, it's a question of being a responsible pet owner, for which they are quite clearly negligent.

The startled dog watched Megan walk across the street and she very gently put her hand out for the dog to smell her. She had done the exact same thing on several other occasions without a problem.

I fail to see how me lying would achieve anything in this debate. I stated the facts. The neighbours back yard has a small track down one edge of there property which links between our road and the next road over.

The lady in question was pregnant (although she didn't know she was at the time) and began to feel faint so took the shortcut through the back yard (she was also pushing a pram aty the time with her 6 month old son in). The dog owners let the dog out of there house without a warning. She got to the invisible fence and the dog stopped.

The owners of the dog came over to her house shortly afterwards and screamed at her for entering there property.

For a person who doesn't know me at all, you've certainly got my personality down. Think for a second! If I was desperate to sue them why would I have come on here and set down the facts asking for other peoples opinions?

You say "Learn to respect dogs" as if you know that I have never owned a dog in my life and that I just see them as cute fluffy toys.

We have not decided whether we are going to take ANY legal action at this time.
