Do I need to file taxes

Hey guys, So I moved here in Sept on a K1. Got married on Sept 14. Got my work papers in Jan. Do I need to file taxes for last year? Also does my wife file as a married person?(as she was only married for part of the year).

My guess: if you didn't have a green card by the 31st December 2008, and you didn't have any US-source income in 2008, you shouldn't have to file. Your wife could file "Married filing separately".

It is possible that it would work out better for you to file as "Married filing jointly". In that case, the things to look into are the process for you to opt to be treated as a "resident alien" for 2008, and then how to deal with any non-US income for 2008.
