TBH if somebody wants me to stay abroad, then change the conditions on me and offer a generous 25% pay cut, it wouldn't be a very hard decision to tell them what to do with that offer.

As you're still under the UK contract I assume they can't force you to take the US one and accepting the US one likely has all sorts of interesting implications when you move back. Like, is the pay cut permanent?

Have you contacted your UK HR rep?

All depends on how badly you want to stay in the US. Once you're here, and if you leave, might be very difficult to get back if you wanted.

Obviously the client that you have been working for is more than happy with your work, thus they have arranged with the outsourcing company to extend the contract and retain you for a further 2 years.

If you and your family really want to stay in the US have you thought about speaking with the client and seeing if they are prepared to sponsor you so you can become an employee and ditch the outsourcing company?

There are probably some clauses in the contract between the client and the outsourcing company to prevent this on a non compete basis and they may have to pay a hefty fee to the outsourcing company if you were to do this plus the costs of the visa etc.... maybe worth looking at?

Also the client might not be happy with the outsourcing company when they find out you are going back to the UK due to not being able to continue on your current terms and conditions of your UK contract of employment.

OH originally came over to the US working for a small UK IT outsourcing company, he retained all his UK terms and conditions including holidays, got a pay increase while in the US, a relocation allowance, help with securing a rental property (they paid the security deposit) and one return flight a year to the UK for all members of the family. Few other things but can't recall just now.

I suppose another way of approaching it might be to say, yeah I'll accept your terms - provided you file an I-140 for me ASAP.

That way if over time you can't claw back your salary and benefits you have the option of working somewhere else, and up front it doesn't cost your employer much.
