I posted a few days ago that I got my approval letter from Newark. However, on the letter I have the adjustment class written as CR6, which I understand is a conditional adjustment. But the date of approval is a good MONTH after our second anniversary date.

Is this an inconsistency or will they check the date of marriage with the date of adjustment and give me the appropriate stamp (unconditional)?

It looks to me someone screwed up...

It depends. Are you 100% sure that the date of approval was after your 2nd wedding anniversary? It doesn't go by the date of the letter. Nor does it go by the date of the stamp. Ask me. I know this for a fact.

Our letter was dated September x and the stamp was given on September 29. But our approval was August 11. So even though the stamp was after the 2nd anniversary approval was before and therefore we were conditional.

When you go for the stamp, find out for sure what the date of approval is.

The letter has the following:

Date of the letter: 10/19/2001 (this is printed)
A#: xx-xxx-xxx (this is printed)
Approval Date: Jan 24, 2002 (this is stamped)
Adj. Class: CR6 (this is printed)

The letter says that the application for adjustment of status has been approved. You should receive the card in 6 months. If you wish to obtain a temporary card, appear in person with this original, valid passport and current photo ID. Appear any Wed between 8 AM and 12 noon. This letter is not valid unless it contains an approval date, adjustment class and the signature of the District Director.

There is no mention of getting a conditional card (except CR6) or any instructions regarding removal of conditions.

My concern is that the people who stamp are fairly low-level and may not WANT to decide if this is conditional or not. I wonder if I should get into a discussion with them at that time and if they can make the appropriate decision.

Oh, and our wedding was in December of 1999.

Then when you go for your stamp be sure to mention that you believe a mistake was made re status because it was approved after your second wedding anniversary. Bring a copy of your marriage certificate with you. Our appointment for the stamp for for a specific date and was with the DAO that did the interview.

As for a notification of removal, we didn't get one with the letter either. It was handed to Jim when he got the stamp and even then the dates for removal are incorrect and the supervisor that called him two weeks ago to follow up on the complaint of service we filed mentioned the wrong dates. According to the INS in NYC we should remove conditons between 6/11 and 9/11 but the approval date was 8/11 which means removal should occur between May 11 and August 11.

Looks like the letter was printed out at a certain time and then when they finished
approving it, they stamped it. Therefore, with a bit of luck, the stamped date is the
right one and you'll get a non-conditional one. I guess you are iether going to have
to go into the office and find out or wait for the GC and argue at that point if
necessary.

Thank you Rita. I'll definately take the marriage certificate with me. I doubt the stamping appt is with the DAO because the letter says to go to the 10th floor and the DAOs sit on the 3rd floor of the federal building in Newark.

I just don't want to have to deal with the 751 if I don't have to!

I thought so too. I guess I'll find out where things stand when I go for my stamp.

I wonder if it's worth it to write to the DAO...he seemed to be on top of things when we went for the interview.
