Child Status Protection Act

Dear All:

If you are wondering about the impact of this new law ( P.L. 107-208 ), you may want to read the analysis of one of law firms.

Some of you will be thrilled and some will be upset about the effective date. I suggest that you hold your fire till the final regs or clarifications come from the INS itself. Even the State department and all the consulates are going to wait for clarification.

Good Luck

The law went into effect immediately for asylum applications because INS had no
regulations to provide for asylum children age-out, and did so rather as a policy
under their discretionary authority.

INS is no doubt developing an interim rule now to implement the law as quickly as
possible into the regulations which did provide age-out implementation.
