Changing H1 status to H4 within US
Hello Experts,
I have changed my H1 from company A to Company B in August 2000. I went to Montreal from stamping on behalf of my company B. Unfortunately I did not get stamped. The reason they gave is they do not have education evaluation previlages and they asked me to go to home country to get the visa. But as my I 94 was valid then I could come back into US. And I still have a valid H1 approval (valid till feb 2003 of company B). Now I am marrying H1 holder here in US. Is it possible to get my H4 stamped after my marriage by sending the passport to St. Louis. Any suggessions will be highly appriciated. Thanks & Regards, Balaji |

No. You can only revalidate visas via St. Louis. However, you could change status to
H-4 while in the US but the next time you go abroad you would need to get an H-4 visa. There shouldn't be the same issues as with the H-1B though because they do not need to check qualifications for an H-4. However, you should note that the rules have changed about getting a visa in Canada (and Mexico). If they deny the visa you can no longer use the I-94 you currently have. You are talking about Visa Revalidation. You need to have the same visa stamped in
your passport for you to apply. Check out: http://www.visapro.com/US-Immigratio...validation.asp http://www.wright.edu/ucie/autovisa.html Paul @ HelpDesk |
