Default Car Insurance Claim

Some of you may recall we had somebody reverse in to the side of our car 4 months ago.

We're still waiting on the deductible of $500 to be paid - the other party's insurer apparently is offering to pay just $250.

I know insurers like to drag their feet and hope we just go away.

Well, before we consider that, we'd like to consider other options, in particular, pursuing this through the small claims court...

... any experiences/advice to share would be welcome, and of course accepted with the usual caveats.

sue them, once they have a judgement against them, then the insurance are bound to pay it as per the policy / liability limits


by them, I mean the person whom hit you. once he gets a summons to court he'll soon be on the phone to his agent.

Yes - sue the other driver for the amount - that's the only way that you will really get their insurance company's attention - it's just the way that the system works ...

I always wonder about this though - won't it cost Harry more than $250 in legal fees to sue the other folk?

In California you can sue for up to $7,500 in small claims court - it costs essentially nothing other than some filing fees (which you can recover as part of the judgment if you win the case)

Don't deposit anything sent to you already, it can be considered as accepting the claim etc and that's that.

Tomorrow, call the insurance company for reimbursement of the full deductible - if not paid back in full, inform them that as soon as you are hanging up the phone, you are immediately calling your state's department of insurance regulatory agency and lodging a formal complaint against them and also placing a call to the state attorney's office of consumer protection. If that doesn't grab their attention then their idiots imo.
