canada to usa and working
 
Hi all

I'm asking this question for a friend, her boyfriend is living in Canada and shes in NY state. They would like the chance to live together before deciding on marriage and have been looking into him living with her and working in the US.
My question is can he work in the US without a work visa ? and if so how long for?

Hello

I am an Immigration Attorney. Your friend's boyfriend cannot work in the US without a proper nonimmigrant classification which permits employment in the U.S.

Depending on his occupation he may be able to qualify for a TN (NAFTA), or H-1B classification or L-1 classification if he works for a multinational corporation or company with offices in both Canada and the U.S.

However, if he indicates that he is coming to work in the U.S., the INS officers at the border or airport may deny him admission into the U.S. Many Canadians forget that their easy access to and from the US, i.e., no visa requirement, is based on the premise that they are just entering for a short visit. All bets are off if there is any indication that a Canadian intends to work in the U.S.
