I need some advice as to whether my company can bill me for costs they have incurred if I choose not to go?

I forgot to say the costs incurred so far would be the immigration submission for our visas and the company arranged for a shipping company to come and view our items to get a rough estimate of costs.

Keep in mind that if you agreed to go and have now changed your mind, it's likely that they'll also decide you can't be trusted to follow through on the arrangements you make! If that's the case, paying them back for their out-of-pocket expenses may be easier than being fired for non-cooperation! Just something to think about.

I have been offered another job in the UK and would resign (not stay with the Co) if I chose not to go. If I moved to the US my job title would change to something that is recognised as a demotion in the UK plus the salary would stay the same. That is why I wanted to check if if their policy was really legally enforceable, that's all.

Of course they can charge you, surely the question is whether you have to pay?

Be aware also that if you are quitting they may just decide to forgo the inconvenience of billing you the amount they claim you owe, and just dock your final pay. The onus would then be on you to try and claw it back.
