Can I rent a room on O1 visa
im surprised I can’t find answers on here regarding this question. I can find for H1B no problem and the visas are similar in regulations and requirements...but can we rent out a spare room as passive income for a few months? thanks :) |

Just to be clear for others reading, your husband has the O-1 visa. Yours is O-3.

Yes, but it should be declared to the IRS as income at year end. It is taxable.

Bearing in mind your other thread - where your OH wants to divorce you and keep the kids in his custoday - I would take advice from a family lawyer before even thinking about bringing a stranger into your home, even if you can do it on an O3. You're going to need a social security number to declare the earnings and so again an immigration lawyer if you aren't filing jointly to check this out.
Honestly, this situation is going to go to hell in a handbasket. Worst case is that you lose your right to stay legally in this country because you divorce before the GC arrives and your OH refuses to let the kids out of the country - which he can. |

Wow so many responses...thank you all! so I am English, my husband is South African. My two eldest, 8 & 5, were born in SA and have dual UK/SA citizenship. Youngest, 2, was born in USA and has dual UK/USA citizenship. I do not have a home of my own I would return to, but would stay with my mother. She has a 3 bedroom house and can support us if necessary. May husband could not live in England if he wanted to. not sure if that answers all questions! |
