Being legal guardian to relatives in UK
 

Hi all

Just had family visiting and a question came up about being the legal guardian to my nephews 3 kids. They wanted to know what would happen to the kids seen as I live here in the US.

Has anyone become the legal guardian of a British citizen living in the UK.

I would assume that you would need to first adopt the kids. Then assuming they're minors, petition them for an immigrant visa.

Really though, if you're intending to stay living here, it makes sense for them to find someone else given how long of a process all of that could take.

While my sister's children were minors, it was in her will that if anything happened to her and her husband, I would become the legal guardian. It was agreed that the children would not be removed from their familiar environment in the UK, and that my capacity would be supervisory as opposed to "moving in." Happily, the guardianship did not have to be activated. You can discuss just how your nephew might envision the guardianship playing out and have that laid out in his will.
