Hi,
I was arrested and charged with sex-for-fee offence by an undercover police woman. In the court, I was asked to pay a fine of $400 and the case was dismissed. I was wondering if this incident will affect my green-card processing? My I-140 has been cleared and I have to make a choice between filing for adjustment of status or councelor processing. Which one should I opt for given the fact that I have an arrest record. I really feel stupid about the whole incodent and wish I could undo it. Any advice will be very helpful. thanks, mark |

Even if the offense is not one which makes you ineligible to immigrate (and I don't think it is such as offense), the consular officer may make you wait a bit while looking into the case. You might be stuck outside the U.S. for awhile. During the adjustment of status process, if the INS makes you wait a bit while looking into the case, you are still in the U.S., working. |
A misdemeanor should not affect your status or processing. As long as you show no
priors or other illegal activity. > > > > > > > > > > > > > > > > |
Go for AOS rather than consular processing. Before filing for AOS though, try to get
this conviction expunged from your record. Your criminal attorney should help you. |
