Default AOS in New York City

Hi, I was on an H1B and I am now going through AOS through my marriage to my USC wife.

2 Questions:

If anyone been through this recently in NY.

What is the time delay for the EAD?

Can you start working before the EAD comes through? (I have SS# etc)

Last example on the AOS experience page was 2001.

What is the time delay for the EAD?

At that time it was 3-1/2 months ... but runs normally between 60 and 90 days

No you cannot. You need INS Authorization with the social security card. Unless your SS card does not have the legend re needing INS worth authorization.

I've no personal experience with NYC INS but you can search deja.com/usenet but I
think you'll find the answer is 90 days

No. If your H-1 is still valid you can still work for the sponsoring company but I'm
guessing "was on an H1B" means it's no longer valid or the job no longer exists.

I'm in exactly the same position. My AOS was filed in early April and still no NOA,
EAD, AP or anything else. In the meantime, I've been offered a better job, and my new
company is doing an H1-B transfer so I can start ASAP, since their immigration
lawyers say that NYC INS is taking the full 90 days to process EADs and APs.

Until your EAD arrives, you can't work for anyone except your current H1-B employer.
However if you have obtained a new job in the same field, you can start work as soon
as the H1-B transfer application is filed - assuming you have remained in status.

Thanks Guys for your help. It looks like I will have to wait out the 90 days then. Oh well, at the least the job market should be looking a little brighter then

If you are not working for the H-1B employer, you may want to wait till you receive
the EAD approval.

You could find out the EAD time delay for NY at:

Hi Troy,

Have you had any response yet, Early April to now is about 90 days, just wondering if there is a further delay, as I filled at the start of May, but need to travel at the start of August. Should I be banging on their door for the AP.

No sign yet - think I'm at day 85. I've just been travelling in and out on my H1-B
and that's what I'll carry on doing even when the EAD and AP arrive (as soon as you
use AP, it ends your H1-B status.)

The only reason I applied for AP and EAD was that I was considering leaving my job
for another industry altogether where I had no experience, thus I wouldn't have
qualified for an H1-B. Since then I switched jobs within the industry and am happy in
my new position, so I just consider myself as an H1-Ber until the AOS interview
happens sometime in the distant murky future.
