Another Injury...who should pay
 
I saw another posting on here and I am hoping I might get a bit of help as well.

My 16 year old visually impaired son (Kevin), broke 4 of his front teeth playing in a National Sanctioned Goal Ball tournement, a game for blind athletes, it hosted by another school for the blind in another state for his School for the blind Goal Ball team last Saturday afternoon. He is a residential student that attends this school for the blind in our state.

While my son was participating in the game and after he made a goal he was making his way back into position by feel, got disoriented and somehow found his way behind the goal instead of in front of it. Now each goal has 2 referee's/"spotter" or observer who stands there next to the goals on each end to make sure the ball is in and that the participant is not out of bounds etc. The spotter admited to seeing our son behind the goal and in the wrong place but our understanding is that he was a volunteer and thought he was not allowed to say anything during game play. Normally from games we have attended the goals are made of padded PVC piping, but this goal apparentley was made of 4" metal and only padded on the front part.

My son heard the ball coming, dove to block and smashed his face and head into the metal portion of the pole breaking/damaging 4 of his front teeth. He was taken to the ER but we were not contacted by people with our son in that state at any time. We only recived a cell phone call from our son afterwards and the Infirmary nurse in OUR state a few hours after being seen at the ER. No xrays and he was sent back to the dorm on pain meds and anibiotic only.

We did not know the serverity of the injuries until that Monday morning when they returned back to our state and we went to the school. We are looking at extensive dental work, orthodioctic work and about 12 months to fix.
We got in at 1.00am this morning from the hospital, his is on pain med's.

Question, should it be my insurance or the schools paying for this? We have already began treatment using our insurance but have not met our $1,000.00 deductible yet.

I also want to point out, NO WAIVER of release of liability was signed to attend this. We signed only permision slip at the beggining of the year for him to play sports and that they could treat him medically. We read our copy of the paper today. It is called a General Consent form. The school is also avoiding our calls. A video below shows how this game was played if you care to see..we can not see how this even happened with the way the refferees are psoistioned on the floor...6 refs for a sanctioned game...

first of all hello and welcome to BE :)

sorry to hear about your son, hope the pain meds are working and he's getting some pain relief!

if you check back on that other thread you mentioned it will have some good advice regarding the insurance companies as i recall.

all the best to kevin ...you're certanly in the right country for new teeth :D ...i'm sure kevin will have the best looking gnashers at the end of the day :)
