Default Am I OK to go home for Xmas?

Hi everyone!

I was granted a CR-1 permanent resident in March, and am currently making plans to return home to England for three weeks at Xmas. Can anyone tell me if there are any restrictions/time limits etc that may be imposed on me? I certainly don't want to be "locked out" when I return to the US!

Do you have the actual Green Card yet? If not, you should obtain an I-551 stamp in your passport. I believe that's sufficient to show legal residence in the US when you return to the US.

Others can answer your question. I wanted to alert you to the fact that you need clearance from the IRS that you've paid taxes. This year is not a problem but I note that you may have filed a return for last year. If it was a part year, there are some different rules. I got stuck trying to find cash or the equivalent for a months gross, on the day I was flying out.

Unless things have changed, all non-USCs have to get clearance from the IRS in order to leave the country. It may have been pushed aside by homeland security, but it's worth checking.

You're thinking of leaving permanently (I think ). If you haven't paid your taxes, they want to bar you from returning under a new visa unless they get to kick thee crap out of you first. But if you're an LPR, the only way they're going to get those taxes out of you is to let you back in through the gate.

The original rule was in case people didn't come back to pay their taxes. It was driven by publicity given to highly paid entertainers and sports figures leaving with large amounts of money, and having paid no taxes. Once the rule was on the books, it applied to non-USCs.

I am not wrong, I got trapped by it. I've been a USC for a while now so I didn't know if it was still practised.

I don't know about the UK Gov. doing it, I've had no occasion to find out.
