Affidavit of Support - Which form?
 
Hello all,

My American fiance is about to prepare an affidavit of support for me. He notes that there are two forms, I-864 and I-134, and is a bit confused on which one to use. It's for my K1 visa, as a followup to our (not yet approved) I-129F petition.

Also, his uncle will be a co-sponsor. I understand that they both fill in a form (the same one). Is this right?

you need the I-134 for your consulate interview,the I-864 is for later on after you've got married and change status. Ihad a co-sponsor and both filled out the I-134 and both send their tax returns for the last 3 years with the forms and any additional proof

hi, i was just reading this thread as I am also preparing my I-134 for a K1
visa.

I will also use a co-sponsor and both myself and the co-sponsor will fill
out a separate form.

However, I don't believe you need to show tax returns with the submission of
the I-134 (unless you are self employed). I think the 3 years of tax forms
are required for the I-864 later down the line.

You might want to double check on this, as will I. Let me know if you learn
something different.

I did my interview last week and if you read your packet 3 on what you need for the affidavit, you will see that all sponsors are required to send in their last 3 years tax returns and I was specifically asked for the tax returns when I presented my forms

here is a posting from a few days ago supporting what I had mentioned about
not needing three years worth of tax returns for the I-134:

Actually, three years of tax returns is usually needed for adjustment of
status or
for a spouse visa. For the fiance visa, provide whatever the consulate
asks for.

you do - there is a great was of information that comes with the downloadable
affidavit of support that states the evidence you need to provide to back up
your affidavit. you need more than one form of evidence - the form on its own
isn't acceptable.

believe me...I've done my interview, you haven't and like everyone else I don't want to see you turned down for your visa coz you never had the right docs...you do need the last 3 years tax returns and they (well did me) specifically ask for them...remember, everyone here is trying to help you get your visa...listen to those that have been through this process!!

Thanks for the support and and info KP. I do appreciate it and hope I wasn't
coming off like don't appreciate the incredible wealth of information that I
read here every day. I certainly am less experienced at this than many as I
just got my return receipt from Vermont. I'm very happy that I read this
thread and put my 2 cents in because now I know what I need thanks to an
experienced person on this ng - no thanks to any instructions i've read from
the INS.

Scarlett, I must have missed this information on the form somewhere but
thanks anyway. And don't worry, you're not the "bearer of bad news" as I
have the last several years of tax returns right here in my home. I was
concerened simply because I don't want to send too much information and
inconvenience an INS employee.

Some (many) consulates also require 3 years tax returns or transcripts,
regardless of being self-employed or not.

Having done your interview is great but remember Kpnuts that the requirements vary from Consulate to Consulate. In Canada it is NOT a requirement and we have done the interview too and know first hand.

As for the instruction sheet, re: Scarlett's reply, it is an either or type document, not a must have everything and/or more than one form of evidence required. That is a mistake I made when we did ours years earlier by supplying bank letter and employment letter. Only the employment letter was required.

But as with all things from the DOS and the DOJ, go by what the office you are using requires. If the Consulate says in packet 3 that tax years are required, then bring them. If they only say supply the I-134, than follow the directions of the I-134.

So, does anyone know what the *London* consulate requires at the interview? (K-1, I-134 no co-sponsor needed, USC is not self-employed). Do we need the tax returns or not? Perhaps someone who has had their interview in London recently can update on this? Thanks in advance! :)

not wanting to be argumentative but something to consider...

the above is fine if the person providing the affidavit is earning 125% above
the relevant poverty line figure. however if that's not the case you will need
further evidence of financial provision in the form of bank statements etc to
show you will not become a 'public charge'.

as the form says, "the sponsor must submit, in duplicate, evidence of income
and resources as appropriate".

my fiancé and i are right on the border of that 125% figure needed for our
family of four so have collected bank statements in addition to employer
letter. i also have a notarised letter offering me employment in the US which
is not part of the affidavit but is allowed to be submitted as part of our
financial evidence as a whole and will be taken into consideration, according
to the embassy - mad really as who the heck knows WHEN i'll get my EAD. ho hum.

I did mine in London and for the affadavit needed the last 3 years tax returns and a letter from my sponsors place of work comfirming she worked there,for how long and what wages she received

Here is the exact wording on DS-2000 'evidence which may be presented to meet
the public charge provisions of the law' which was sent to me from the London
embassy.

under the section
AFFIDAVIT OF SUPPORT

To substantiate the information regarding income and resources the sponsor
should attach TWO OR MORE of the following items to the affidavit:

1. notarized copies of his or her latest federal income tax return

2. a statement from his or her employer showing salary and the length and
permanency of employment

3. a statement from an officer of a bank regarding his or her account, the date
the account was opened, and the present balance

4. any other evidence adequate to establish financial ability to carry out his
or her undertaking toward the applicant for what might be an indefinite period
of time

(nb affidavits are good for one year only, the form says)
