Default 15 Year old Son - can he work?????

Hi All,

Myself and my family are int he states on an L1/L2 Visa and are in the process of starting our Green Card. Our Visa is due to be renewed next April. My eldest Son will be 15 in October and wants to look at getting a weekend job and then possibly some Summer work/internship. Will he have to get an EAD card to allow him to work before we get our Green Card?

Yup - just the spouse.

See I-765 instructions - no category code for L-2 children.

Spouse of an L-1 Intracompany Transferee--
(a)(18).
File Form I-765 with evidence of your lawful status and evidence you are a spouse of a principal L-1, such as your Form I-94, and a copy of the principal's visa and your marriage certificate. (Other relatives or dependents of L-1 aliens who are in L status are not eligible for employment authorization and may not file under this category.)

Yes.

The kid could get the EAD based on the AOS of the greencard application though, which is what I meant.

yeah the kiddo on an l2 cant even get an ssn - have to use an itin until they get green card.

Once your Green Card/AOS application has been submitted, your family members usually get their EAD cards within 90 days. We were lucky and got ours within 45 days. I have 2 teens who are desperate to earn some money this summer. Good luck.

When the employer files the AOS package, make sure an I-765 application for EAD is included for the son.

He can't work until he has this EAD in hand.

have to be 18 for Home Depot and Lowes, well at least in Texas due to dangerous equipment rules. I suspect if Texas is 18, most others will be as well.
