I need help can i still be deported.
I came to u.s.a on A J-1 VISA with no demand return on it.It expired a
few yrs back and i just got married a week ago to my fiance who is a
american.I need to know i just filed my papers today can I.N.S STILL
COME AND DEPORT ME EVEN THOUGH I JUST GOT MARRRIED OR AM I SAFE FOR
NOW.Please anyone with answer please help me I am worried now. thanks

One week seems a bit fast -- did you submit a proper marriage certificate
from the hall of records (not the marriage license)?
If you properly filed Form I-485, together with your spouse's Form I-130, at
the USCIS district office for your residence, you are safe and you will not
be deported.
This also assumes you are not an axe murderer or anything similar.

Well there is no such animal as INS and has not been for a few years. The CIS will not deport you if you and your new husband were to file your adjustment of status papers.
I would not, however, every leave the US even with advance parole before getting a green card as you are subject to a ban for having overstayed your original visa by more than 180 days.

Believe it or not, if she was a J-1 and was never denied a benefit or encountered in the US, then there wouldn't be a ban at all. It's a funky loophole for D/S admission that I'm not fond of.

I am glad that to read this thread. I was assumign that people prove
their marrige with marriage license.
Would you be able to tell me whether someone will be able to do AOS
immidiately through a spouse who entered US on refugee status and is a
GC holder but not a US citizen yet? Is there a waiting time period
(just like 1 year waiting period for the refugee after arriving US)
before the AOS can be filed? In the mean time, can the person apply
for EAD during that waiting period?
