Are you relying on the "business" attorneys for immigration advice? If so I would strongly recommend that you involve an immigration lawyer ASAP so that the business model will meet the immigration/ visa requirements with a minimum of changes, and stress, later when the visa applications are being processed.

If you are taking about a B1 in lieu of H1b the activities he can engage in are limited, and I have never seen one of these issued:

Oh, always . To be fair, I think he has been bamboozled oduring the last trip with the influx of legal information from a different country, it takes him a while to process it and give me the information.

He met with both an immigration attorney and a business attorney (seperate firms) last week whilst he was over there. My point was that the business attorney should be setting the business up to make the immigration attorney's life easier but whether that is / will happen is the next challenge!

Well the question of why this operation was set up in a non Immigration friendly format still applies.I assume the other party would not want to be a minority shareholder.
