Ok I am here in Canada i have been living here for 25 years as a p/r I am waiting for my fiance in the u.s.a to apply for me to go live over there with our baby. Heres the catch, he does not make enough money yet to support us and he has no one to sign for us so i basically have to wait untill he starts his new job and starts bringin in the doe- this means i have to be in canada for at least another 6 or 7 months - ok heres my question Would it really complicate things for us if i went to scotland instead of waiting for the 6 months here in canada? I just hate canada so much and I would love to go see my parents in scotland so what if i went there and waited for my fiance to fill out our papers and so on? I just dont want to be here in can for another 6 or more months. Im not sure though if it will complicate things for the ins.. i know this is kinda confusing but any help will be appreciated.

Just to clarify...

You say you are a 'permanent resident' in Canada rather than a citizen and that your parents live in Scotland? Does this mean you are a UK citizen?

If so, and you have not yet filed any of your papers, I can't see any reason why you shouldn't go back to Scotland. You are going to need a police certificate for the time you have been in Canada so it might be worth applying for that before you go.

I can't see how you would complicate things by moving. And the UK embassy is really very quick about processing K1s.

The only complication I could see would be if you were not a UK citizen, or if you already have some papers filed with the INS, which sounds unlikely from what you say.

Going through this process really takes it out of you. The support of your parents would probably make things a lot easier on you - especially since you have a baby too. BTW, the baby possibly has a claim to US citizenship in its own right because of your fiancé.

If i've misread you let me know. I'm not a lawyer or anything. This is all just an opinion from another K1er. You should listen to a few more opinions before you make a final decision.

What is it about Canada that you hate? The US and Canada are not that
different in many ways. Are you sure you want to move to the US??

Oh Im sorry its not Canada itself that i hate its actually montreal the need for french not having my parents or any family I didnt mean for it to sound that way I should of said i hate BEING in canada right now.

I am a Canadian living in the U.S. and as poster here said, "there is
no real difference living here from living in Canada". Hopefully one
day we will not see you on here saying that you really hate the U.S.,
then what? Just my thoughts.

I agree with Scarlett.

If I read your story well: you wish to emigrate to the USA,
to be able to live with your baby and your fiance. I can
imagine marrying is mandatory for INS. And during the
process you want to go back to Scotland.

My assessment is: why not? You are a UK citizen. What you
should think about however (IMHO) is whether you will apply
for that visa for you and the baby as a Canadian PR or as a
UK citizen. My guess is as a Canadina PR would be more
simple. If you do it out of the UK as a citizen, you will
need lots of stuff from the 25 years you lived in Canada,
the other way around you will not need that from the UK that
has been too long ago. Other then a Birth Certificate .

Also: you are leaving Canada for a few months. I doubt if
the US INS is aware of that fact. They don't have any
jurisdiction there do they? So maybe applying for the visa
to the US, and asking someone to mail the stuff to Scotland,
would solve it? Handle it and mail it back to your contact
person, who will deal with that. After you get an invitation
to come to the US Embassee or Consulate in Montreal, you
will have to travel back. After that it is: stay put. Won't
take long.

OK like Scarlett: my two cents, I am also just a K-1 driver.

PS: I see qualified posters saying that going over to the US
(on a visa waiver for instance) and just get married is not
impossible. The problem is: then you will not see Scotland
for a substantial amount of time, until you have your Greencard.
