Default What are my chances?

My UK mother re-married to an American who has been
working over here in the UK for 11 years. When I was 22.

So my natural parents are both British
and my step father is American.

My brother has been living in the US for 4 years now, he
has married an American too and he has his green card. He is
thinking about taking up dual nationality (UK/US)

I'm 24 with an IT degree, what are my chances of making
a move to the USA from the UK?

If your brother becomes a US citizen he could petition you to immigrate
to the US. See

This would take quite a long time, I believe. He cannot file a petition
for a sibling as a permanent resident.

Another way is via employment (H-1B visa). This requires a sponsoring
company and in today's economy it would likely be a difficult task.

As stated your brother can petition your permanent residency (green card), however he needs to be a citizen. He can apply for citizenship 3 years after HIS green card was approved. Once he becomes a citizen which can take many months between filing and being sworn in, he can file a petition for you to move to the US.

Unfortunately your 4th preference for family sponsored green cards in the eyes of the INS. This website should clarify this

Also for you to get a H1-B you need an US employer to sponsor you and prove to the INS that you have skills/experience/knowledge which cannot be equalled by the natives who also applied for the job. A very difficult process for a 24yo with a degree and little experience. Many employer will not consider sponsorship since in the tech world there are more unemployed people than jobs here.

Green card through your brother is thus far your most viable option, this may take a good few years however.

My brother managed to get a sponsor by getting the US company to tailor
the job spec to my brothers skills, i.e. they needed someone who has such and
such skills plus knowledge of a small town in England (where my brother
was from)

I was wondering if my borher could setup a company and do the same thing
for me? Or perhaps find someone with an IT company to do this for me?

Note that this can cause problems. The job description has to have merit, i.e.,
why would knowledge of the small town be needed? Stuff like this would require
that the company actually does business there. They can not just write arbitrary
things in the job description.

They are an IT firm that try to help find positions all over the world for people in IT. They were very helpful to us 5 years ago. we didn't end up using them for any of the jobs they found (Husband got a transfer through company instead) but they did have quite a few jobs in line that my husband could do.

Things could be very different now because of the job situation over here. As has already been said, there are a lot of IT people out of work in this country.

I understand, though, that they help arrange your visas and everything. Send them an e-mail explaining what you want and see if they can help.

I think I've read somewhere that, this can take between 7-11 years tho!

Stuart,
Another long shot is to have your mother get a green card and file a
petition for you. This probably takes about 5-6 years but this will be
better that have your brother do that for you. Another catch is that, you
still remain unmarried.
