Waiver?
Hi,
Since I got no answers to my last thread I thought I would give it
another shot.
Here we go, I was in USA on F-1 visa, started 2002, missed a year in
2005, completed 2006, returned home to UK for Xmas just gone. Tried to
go back, turned away at Atlanta, refused a visa in London on 2nd March
under 214b, applied in Belfast on 15th March didnt get a letter or code
have since emailed them still waiting on a reply. Just want to know that
if they come back with a 3 year ban on me for the year of school I
missed, how do I go about getting a waiver of this ineligibility. All I
can find is the consular 'may' request a waiver. I want to request one
if necersary. How do I do this? I only have one more year left on my
degree and this is holding my life up. Oh by the way no trouble with the
police anywhere, only the year I missed of school where I left the US on
my own free will with no hearings or anything like that.
Please help.

Though I doubt that anyone here will be able to give you useful advice - time to call an immigration attorney, methinks.
Or consider completing your degree at an American university outside the US, eg AUB.

Can you clarify a couple of things:
When you were denied entry, what was the reason? What did they stamp on your passport?
If you left the US during your year off school, what is the ban in regard to?

During my time out of school I was barly getting by, and trying to get
back into school. I was not working and I have stressed that to the
officials over and over again. I see that I can ask for a waiver of this
ineligibilty next time I go to the embassy for an f-1 visa. Any ideas on
how this works? i.e. what forms or documentation would i need.

Thanks for the replies.
I was dnied entry on the 3rd Jan 2007 for not having a valid visa I
believe. I had my application withdrawn I wasn't deported.
As for what was written in my visa, they wrote cancelled across my visa
with the following:
22CFR41.122(h)3
212(a)(7)(A)(i)(I) APP WITHDRAWN.
I think this part of the law just means that I didn't have a valid visa.
The lady at Atlanta airport said I should be able to get another F-1
Visa. How wrong she may have been!
