Waiting for Name Check and Emergency Travel
I am american and my wife is from China, we passed our interview in
October and are waiting for the name check so she can get her Green
Card. In the meanwhile one of her relatives is very sick and my wife is
having anxiety over not seeing her loved one. We were interviewed in
Seattle. I have made contact with a senator's office in WA, but I am
not sure what else I can do. Any ideas? Or more details needed?
Thank you very much,
Patrick Rogers

Do you have reasons to doubt that an Advance Parole could allow her to come
back to the US after visiting her sick relatives?

My immigration Lawyer said she can not leave the US without the
greencard. I thought with advance parole waiting for adjustment of
status, you must remain in the country. Am I a wrong? Thanks for any
help.

With "advance parole waiting for adjustment of status," a person may travel
outside the U.S. and re-enter. The only exception is if your wife
overstayed her authorized temporary stay in the past, and a departure from
the U.S. would make her subject to the 3 or 10 year bar.
You should ask the attorney why he insists that your wife must not leave the
U.S. even with advance parole. If the answer is that the I-485 may be
approved while she is gone, there is a procedure for that.
