Hello everyone!

ANY INPUT GREATLY APRECIATED, situation is desperate.

My husband is working in the US,
I have been in the US many times before.

I've applied for an H-4 visa in Moscow embassy in November 2002.
Because of prior shoplifting incident had to submit fingerprints, and
was told it would take 6 to 8 weeks to process.

It has been 7 months!!!!; no visa, all I can get from the Embassy is
"additional administrative processing has not been completed yet",
they refuse to talk to you.

I have read a lot that due to Sept. 11 attacks there have been new
security checks, etc. but how long can this take??? They must be
drowning with teh volume of checks or smth...

They say all documents are fine; they are just waiting for the answer
from some "agency' in Washington.


- 1. DOES ANYONE HAVE ANY IDEA HOW LONG THESE CHECKS TAKE?
Is anybody in a similar bind? HOW LONG DID IT TAKE TO RECEIVE A VISA?


-2. Would it be any faster processed in LOndon (my husband UK
citizen), would it make any sense to go and apply there?

I am on the verge of a nervous breakdown, havent' seen my husband in
almost a year -
if anybody knows anything about this, PLEASE post or email, I WOULD BE
MOST GRATEFUL!!!!!!!!!!!!!!!!!!!!

Shoplifting is a CIMT offense covered in the Grounds of Inadmissibility for
Alien applicants for admission into the US. [ INA 212(a)(2)(A)(i)(I) ]

Th statute is very strict about people applying for admission into the US
who had committed CIMT. Whether or not you agree shoplifting should be
considered a CIMT is something you have to deal with the system. Moreover,
even if you can get a visa it's still a possibility an immigration inspector
at the port of entry can deny you admission based on that criminal record.
Such denial would be unappealable in courts.

Alien admission into the US is not right. If you are ineligible due to
something you have done in your volition you should not complain and fault
somebody else but youself. Tough as it may be, it was you who made the
mistake.

When the the consular people told you, ""additional administrative
processing has not been completed yet", they may just be working on your own
benefit by finding ways to accomodate you without subverting the law. They
may or may not find something to your advantage but you should be ready to
accept the negative consequence of your criminal action.
