Visa priority dates changed dramatically?
Hi,
A couple months ago, i checked the visa bulletin, and saw that the 1b category
(family of citizens) priority date was sometime in 1999. Now I just checked
again, and its 1995 now. Why did it go back 4 years?! will it come back to 1999?
this is weird.
thanks

Sorry, I meant that the priority date is now 1996, not 1995. Still, thats a huge
change from 1999!

Quite strange. Even the 2B category has proceeded along quite quickly. My theory is
that lots of people are dropping their petitions to stay in the US which leaves more
options for those who do want to stay. Or maybe it's our Republican adminstration
which just loves foreigners . OK, seriously, I don't know the reason.

Not that strange. This is all a result of 245(i). During the short time
245(i) was brought back, lots of people who weren't otherwise eligible for AOS filed
their I-485s. Of course, that had to result in a big retrogression of the PDs.

Where is 245(i)?
I could not find it in 8 CFR, or I don't know where to look.
8 CFR PART 245 -- ADJUSTMENT OF STATUS TO THAT OF PERSON ADMITTED FOR
PERMANENT RESIDENCE
This one has 245.1, 245.2, etc.
Subpart A--Immigration Reform and Control Act of 1986 (IRCA) Legalization Provisions
(Sections 245a.1 through 5 designated as Subpart A, 6/1/01; 66 FR
29661)
This one only has 245a.

Re: Visa priority dates changed dramatically?
245(i) is part of the law, not part of the regulations. The full reference is
Immigration and Nationality Act section
245(j), available through -

8 CFR means 8 Code of Federal Regulations. Regulations are issued by an agency in
the Executive Branch, to implement the law which is passed by Congress.
